Transfer of Tribal land

If the land is to be transferred owned by the one Tribal person to the another Tribal person for agriculture purpose by way of sale, exchange ,Gift etc. which comes u/s 36 and 36A of the M.L.R.C. 1966 the Collectors of the Districts are competent to accord section to the above proposals as per Govt. circular dated 8/9/83, however the lands can not be transferred without previous consent of the Divisional Commissioner. The scrutiny of such proposals is being made by the land reforms branch in the Commissionerate. After compliance of all relevant case papers saction order is being issued.

If the lands held by the tribal is to be transferred for the purpose of non agricultural purpose to the Non tribal person the power to accord sanction to such proposals are with Govt. As well as the proposals regarding lands held on new tennure are also required to be submitted to Govt. with due scrutiny such proposals are supposed to be submitted by the Collectors of the concerned Dist. through the Divisional Commissioner. The Commissioners office scrutinise the above said proposals and after having been full compliance the proposals are being submitted to Govt.for final decision.

As per Govt circular dated 19/4/79 the lands of restricted tennure or falling u/s 43 of the Bombay Tenancy and Agriculture lands Act 1948 (Lands belonging Nomadics tribes and Vimukta Jaties) the proposals for the transfer of lands by way of sale deed, exchange,  Gift etc. are to be considered by the Govt. however its scrutiny and submission is expected to be done by the Collector and Commissioner of the respective Dist. Govt. is very keen and carefull while according sanction to these proposals. The compliance of case papers scrutiny correspondence in this regard etc. is being done by the Land Reforms Branch of the Commissioner.
