The Resettlement Branch in the Divisional Commissioner office is expedient to consolidated and amend the law relating to the rehabilitation Act called MAHARASHTRA PROJECT AFFECTED PERSONS REHABILITATION ACT 1999. The act apply to the irrigation projects which area of the affected zone exceed 50 hectares or area of the benefited zone exceeds 200 hectares or gaothan/s is affected. It also apply to all projects, other than irrigation projects such as industrial estates, atomic energy, universities, oil and natural gas, energy, chemicals, roads, national parks, sanctuary, mines etc. However the entire responsibility to execute them and to rehabilitate the P.A.P.s shall rest to concern department by entering into an agreement with the concerned project authority or body. The act is not applicable for the projects falling under the jurisdiction of inter-State Projects and rehabilitation work, financed by the external agencies.

Functions

  • The Resettlement branch works as superintendence, direction and controlling in all matters connected with the rehabilitation of affected persons in a Revenue Division-containing 5 districts.
  • Branch co-ordinates and supervise the work of rehabilitation of affected persons in the division.
  • Co-ordinate & ensure speedy rehabilitation of affected persons by requiring the Collectors & the project authority concerned to undertake the work of rehabilitation.
  • Performs such other functions time to time as per the State Government directions.
  • The Resettlement branch of the commissioner office publishes the preliminary notification in the Official Government Gazette specifying the village or areas which are likely to be in the affected or/and benefited zone, slab and other things under section 11(1) of the Act.
  • There are restrictions on transfer, sub-division, partition, conversion or improvement of land until collector makes a declaration that no further land in the benefited zone is required for the purpose. The commissioner gives the special permission to sale from the restricted land subject to conditions provided by the clause no.12 of the Act. This powers of the clause 12 are delegated to the collectors in this division.
  • Final notification under the section 13(3) of the Act the Commissioner (office) publishes, the extent of area which shall constitute the detailed area of affected & benefited zone and other things under the project, not later than three years in case of major irrigation projects and not later than one year in case of other projects from the date of publication of notification under section 11.
  • Government provides civic amenities in the prescribed scale and manner in the new rehabilitation gaothan listed and mentioned in the clause 10(3) of the act to the project affected persons.
  • The said office gives the administrative approval to the estimates of the civic amenities. Commissioner office controls the total cost of the rehabilitation that it should not raise above 5 % of the cost of the project.
  • Resettlement Branch of the Divisional Commissioner Office is controlling authority of the Sardar Sarovar Project Office at Nandurbar and supervises the various functions executed by the Collector of Nandurbar Narmada Control Authority. The Nandurbar Collector & Narmada Wikas Wibhag designed the separate web sight for Sardar Sarovar Project.
  • Resettlement branch of the Divisional Commissioner Office Performs various other functions time to time as per the Divisional Commissioner & the State Government directions.
